Milpitas has a mix of older tract housing and newer development. On the older stock, additions and ADUs both pencil — the deciding factor is usually where utilities run and how much usable rear yard is left.
The Milpitas rule that catches people out is construction waste. The City applies CALGreen construction and demolition recycling to residential work with no dollar threshold at all. Its own table says it applies to a newly constructed building, or an “addition or alteration that increases conditioned space”, or a demolition permit pulled in preparation for one. A heated 260 square foot addition triggers it exactly as a new house does. The requirement is to divert 65% of project waste from landfill.
It is also a two-part filing that lives in two different departments, which is where jobs get stuck. Recycling Report Part I goes to Building before the permit is released — the City states plainly that the permit will not be released without it. Part II goes to Public Works before final inspection. And a hauler weight ticket is not a diversion report: tonnage proves what left the site, while the diversion certificate has to come from the receiving facility. Milpitas also has an exclusive franchised hauler for debris boxes, so a sub who brings their own bin can cost you the tonnage credit.
Practically, that means segregating a clean wood box and keeping concrete separate. Concrete is heavy and close to fully recyclable, so those tickets move the diversion percentage more than anything else on site. We put the service address and permit number on every debris-box work order so the tonnage can actually be tied back to the permit.
